Drug Charges in Tennessee

Although simple possession or casual exchange is the lowest level of drug charge, possession of only a small amount of drugs can be charged as a Class A misdemeanor, punishable by up to a year in jail with fines of up to $2,500. You may also be required to complete a drug education program and probation. For a second possession offense, you will likely face a Class E felony charge, which carries up to six years in prison and fines of up to $3,000.

You may also face a separate charge of having drug paraphernalia which is also a Class A misdemeanor. Factors that can enhance penalties in any drug possession charges include those that occur within 1,000 feet of a school, playground, park, or daycare facility and those involving weapons. These aggravating factors can incur mandatory sentences and do away with the opportunity for probation in lieu of jail time.
