What are Traffic Crimes in Tennessee?

Traffic offenses that will result in criminal charges in Tennessee can include:

  • Speeding, generally charged as a Class C misdemeanor

  • Reckless driving, charged as a Class B misdemeanor

  • Drag racing, charged as a Class B misdemeanor

  • Reckless endangerment, charged as a Class A misdemeanor

  • DUI, charged as a misdemeanor or felony depending on if you have previous convictions

  • Leaving the scene of an accident, charged as a Class C misdemeanor

  • Driving without a license in your possession or having never obtained one, charged as a Class C misdemeanor

  • Driving with a suspended or revoked license can be charged as a Class B misdemeanor

  • Vehicular manslaughter, charged as Class B felony

Penalties can include fines, court costs, jail time, probation, points added to your driving record, suspension or revocation of your driver’s license, and increased car insurance premiums.

Class C misdemeanor convictions carry penalties of up to 30 days in jail and fines of up to $50. Class B misdemeanors carry penalties of up to six months in jail and/or fines of up to $500. Class A misdemeanors are punishable by up to a year in jail and/or fines of up to $2,500. Felonies are punishable by more than a year of imprisonment along with fines. Beyond this, you will have a permanent criminal record that can be a distinct disadvantage in the future when applying for employment, housing, professional licenses, or educational aid.

Examples of points added to your driving record when convicted of a traffic crime or citation include four points for speeding 16 up to 25 miles per hour above the posted limit, eight points for the misdemeanor of reckless endangerment by vehicle, six points for license violation, and eight points for driving with a canceled license or fleeing law enforcement. If you accumulate 12 or more points within a one-year period, your license can be suspended by the Tennessee Department of Safety.
